JLR Network LLC, d/b/a Radon Relay – Terms of Service (tos_v1.5)
Effective Date: February 24, 2026
These Terms of Service ("Terms") are entered into by and between you and JLR Network LLC, a New Jersey limited liability company, doing business as Radon Relay ("Radon Relay," "we," "us," or "our"). These Terms govern your access to and use of the Radon Relay website, applications, and related services (collectively, the "Platform").
By accessing or using the Platform, you agree to be bound by these Terms.
1. Platform Role and Nature of Service
JLR Network LLC, d/b/a Radon Relay, operates a technology platform that facilitates scheduling, coordination, and communication between independent third parties involved in radon-related activities.
Radon Relay does not:
- Perform radon testing, measurement, retrieval, delivery, mailing, analysis, or mitigation
- Employ, supervise, or control radon professionals
- Provide environmental, laboratory, or regulatory services
- Assume responsibility for regulatory compliance
All radon-related services are performed solely by independent third parties.
Current Service Scope: The Platform currently supports relay coordination for charcoal canister radon test kits for single-family residential dwellings only. Support for additional testing methods, property types, or services may be added in the future at Radon Relay's discretion.
2. Eligibility and Certification Requirement
Access to certain Platform features is limited to individuals who hold valid and current certifications required by applicable law, including Certified Radon Measurement Technicians where required.
By using the Platform, you represent and warrant that you:
- Hold all licenses, certifications, and approvals required by law
- Maintain those credentials in good standing
- Will immediately cease use of restricted Platform features if your certification becomes invalid
3. Certification Upload, Verification, and Access Control
By uploading, submitting, or maintaining any certification or credential on the Platform, you acknowledge and agree that:
Sole Responsibility: You are solely responsible for the accuracy, authenticity, and validity of all certifications you submit.
User Representations: You represent and warrant that:
- The certification belongs to you
- It was lawfully issued
- It is active, unexpired, and not suspended or revoked
No Authorization by Radon Relay: Uploading a certification does not constitute approval, endorsement, supervision, or authorization by Radon Relay to perform regulated services.
Limited Review Only: Radon Relay may review certifications solely for platform eligibility purposes and does not independently verify ongoing compliance.
Automatic Access Restriction: If a certification expires, becomes invalid, is suspended or revoked, or is reasonably believed to be inaccurate or misleading, your ability to request radon pickups, accept pickup requests, or perform pickups through the Platform may be automatically suspended or restricted, without prior notice, until valid certification is restored.
Duty to Update: You agree to promptly update or remove any certification that changes status and to immediately cease restricted activity while uncertified.
Indemnification: You agree to indemnify and hold harmless Radon Relay from any claims, penalties, fines, or liabilities arising from false, misleading, expired, or unauthorized certification submissions.
4. Independent Contractor Status
All users operate as independent contractors. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship.
5. No Liability for Runner Conduct
Runners who accept relay requests through the Platform are independent third parties. Runners are NOT employees, agents, or representatives of Radon Relay or JLR Network LLC.
Limitation of Liability: Radon Relay is not responsible or liable for any property damage, personal injury, loss, theft, or other harm caused by runners, except where expressly required by applicable law. By using the Platform, you acknowledge and accept this limitation.
Requesters are solely responsible for decisions regarding property access and entry authorization.
6. No Background Checks or Screening
Radon Relay does NOT conduct criminal background checks, driving record checks, or other personal screening of runners beyond verification of radon measurement certification credentials required for Platform eligibility.
Radon Relay does not verify runner suitability, character, judgment, or qualifications beyond the certification requirements stated in these Terms.
By using the Platform, requesters acknowledge and accept this limitation and assume responsibility for their own decisions regarding approval of runners.
7. Authorized Pickup Only
Radon canisters may only be retrieved by the specific individual runner assigned to the job through the Radon Relay platform.
Prohibited Conduct:
- Runners may not delegate, transfer, or assign pickup responsibilities to any other person
- Requesters may not authorize third parties to retrieve canisters outside the Platform assignment
- Pickups performed by anyone other than the assigned runner are invalid and not recognized by the Platform
Violation of this policy may result in immediate suspension or termination of Platform access.
8. No Proxy or Substitute Retrievals
Radon Relay does not permit proxy, substitute, or "on your behalf" pickups. Only the individual runner assigned to a relay through the Platform may perform the pickup and submit verification proof.
Any retrieval performed outside the assigned workflow is not recognized by Radon Relay and may void payment eligibility and Platform protections.
This policy ensures chain-of-custody integrity and regulatory compliance for radon test handling.
9. Runner Reliability and Approval System
The Platform maintains a reliability tracking system ("Scorecard") for users who accept relay requests ("Runners"). The Scorecard tracks performance metrics including missed deadlines, cancellations, complaints, and feedback from other users.
Auto-Approval: Runners with a clean Scorecard (no missed deadlines, fewer than two cancellations, no confirmed complaints, and fewer than two negative feedback ratings) are automatically approved when they accept a relay request.
Manual Approval: Runners whose Scorecard indicates potential reliability concerns require manual approval from the requesting user. The requester may review the Runner's Scorecard and choose to approve or decline the Runner. If declined, the relay request returns to "open" status for other Runners to accept.
No Guarantee: The Scorecard system is provided for informational purposes only. Radon Relay does not guarantee the accuracy of Scorecard data, the reliability of any Runner, or the outcome of any relay. Users are solely responsible for their own decisions regarding approval or acceptance of relay requests.
10. Proof of Completion Workflow
The Platform requires Runners to submit proof of completion for each relay, including:
- Pickup Photos: A photo of each canister showing the canister label and room context
- Tracking Number: The shipping carrier's tracking number (USPS, FedEx, UPS, or other)
- Drop-off Proof: A photo showing the canister at the carrier drop location
Upon submission of complete proof (all canister photos, tracking number, and drop-off photo), the Runner becomes eligible for payment. Once drop-off proof is submitted and payment eligibility begins, Runner payout shall not be clawed back due to carrier loss, delay, or delivery failure. The Runner's responsibility ends upon confirmed drop-off at the carrier location.
Radon Relay does not guarantee delivery outcomes after the canister enters the carrier's custody.
11. Transactions Between Users
Any agreements or transactions facilitated through the Platform occur directly between users. Radon Relay is not a party to those agreements and disclaims liability related to:
- Service quality or outcomes
- Timing or completion
- Chain of custody
- Regulatory compliance
12. Fees
Radon Relay may charge platform facilitation fees disclosed prior to confirmation. These fees compensate Radon Relay for operating the Platform and do not represent payment for radon services.
13. Disclaimer of Warranties
The Platform is provided "as is" and "as available." Radon Relay disclaims all warranties, express or implied.
14. Schedule Book, Route, and Job Information
The Platform provides scheduling tools, route optimization, and job management features (collectively, "Scheduling Tools") for informational and coordination purposes only. Radon Relay does not guarantee the accuracy, completeness, timeliness, or reliability of any scheduling data, route information, job details, deadlines, addresses, or other information displayed through the Scheduling Tools.
User Responsibility to Verify: You are solely responsible for independently verifying and confirming all job details, scheduled dates and times, pickup addresses, entry instructions, route assignments, and deadlines before acting on any information presented by the Platform.
No Liability for Inaccuracies: Radon Relay shall not be liable for any loss, damage, missed deadlines, failed pickups, regulatory violations, or other adverse outcomes arising from inaccuracies, errors, omissions, or delays in the information displayed by the Scheduling Tools.
Data Currency: Scheduling information may not reflect real-time conditions. Job statuses, availability, deadlines, and route details may change without notice.
15. Limitation of Liability
To the maximum extent permitted by law, Radon Relay shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform.
16. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.
17. Trade Name Disclaimer
Radon Relay is a trade name and platform operated by JLR Network LLC and does not constitute a separate legal entity.
18. No Mileage or Travel Reimbursement
Radon Relay does not provide mileage reimbursement, travel compensation, fuel stipends, or any other form of travel-related payment to users. All transportation costs incurred in connection with relay pickups, deliveries, or any other Platform-related activity are the sole responsibility of the user.
Users are independent contractors who determine their own routes, schedules, and methods of transportation. By using the Platform, you acknowledge and agree that Radon Relay has no obligation to reimburse or compensate you for travel expenses of any kind.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
20. Affiliated Business Requirement
Runners must declare their affiliated lab businesses during registration. Each job posted on the Platform specifies which lab's canisters are being picked up. Only runners affiliated with the designated lab may accept that job. Radon Relay enforces affiliation matching to maintain chain-of-custody integrity and prevent canister mix-ups.
Users must keep their affiliated businesses up to date. To modify affiliated businesses after registration, users must contact a Platform administrator. Falsifying lab affiliations or misrepresenting business relationships may result in account suspension or permanent termination.
Only runners affiliated with the designated lab may accept a given job. Affiliation is managed by Platform administrators after registration.
21. Dispute Resolution and Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform ("Dispute") shall be resolved exclusively through binding arbitration, except as otherwise provided herein. By agreeing to these Terms, you waive your right to participate in a class action lawsuit or class-wide arbitration.
Informal Resolution First: Before initiating arbitration, the parties agree to attempt to resolve any Dispute informally by contacting support@radonrelay.com. The parties shall have thirty (30) days from the date of the initial written notice to resolve the Dispute informally.
Arbitration Procedure: If the Dispute is not resolved informally within 30 days, either party may initiate binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall be conducted by a single arbitrator in the State of New Jersey. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Exceptions: Either party may bring an individual action in small claims court for Disputes within the court's jurisdictional limits. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
Class Action Waiver: All Disputes must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
22. Modification of Terms
Radon Relay reserves the right to modify, update, or revise these Terms at any time at its sole discretion. When material changes are made, the updated Terms will be posted on the Platform with a new effective date, and users will be required to review and re-accept the updated Terms before continuing to use the Platform.
Continued use of the Platform after being presented with updated Terms constitutes acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Platform. Radon Relay will make reasonable efforts to notify users of significant changes, but it is your responsibility to review the Terms periodically.
